The present General Terms and Conditions of Sale (referenced as “GTCS”) aim to define the contractual relation between the Service Provider and the Client and the terms applying to any purchase made through the website www.cinetoc.com by a non-professional Client.
The Service Provider coordinates are the following:

2/ Scope of application
The present GTCS apply with no restriction or reservation tout any purchase of service proposed to the website www.cinetoc.com by the Service Provider to the non professional Client.
The main features of the services are presented on the website and the Client has to acknowledge them before placing an order. The choice and purchase of a Service is the Client’s sole responsibility.
These GTCS are available at any time on the website and prevail over any other document. The Client declares having acknowledged of the present GTCS and having accepted them by clicking the specific checkbox before placing an order. unless proven differently, data collected on the Service Provider hosting service constitute proof of the transactions concluded with the Client.
The Service Provider reserves the right to modify the terms of sale at any time. In this case, the Terms applicable will be the ones effective on the date of the Client’s order.
3/ Characteristics of provided services
The products and Services provided are as proposed on the website www.cinetoc.com. They are directed to adults (over 18 years of age) unless stated differently. Every Service comes with a detailed description set by the Service Provider.
4/ Pricing
The Services are provided on the prices appearing on the website when placing the order.
Prices are set in Euros all Taxes Included.
Prices are fixed and non adjustable during their period of validity but the Service Provider reserves the right – out of a validity period – to review and modify prices any given moment.
Prices may include a price cutting granted by the Service Provider.
The payement asked to the Client matches the total amount of the purchase.
Credit card payement constitutes proof of the transaction.
A bill is prepared and sent to the Client by the Service Provider at the end of the provided Service.
5/ Purchases
It is the Client’s discretion to select on the website the Services he/she wishes to order.
The Client wishing to purchase a service is required to:
Complet the identification sheet indicating adresse and phone number coordinates and information required
Validate the order after having checked it
Proceed to the payement following the procedure
Confirm his order and payement.
The confirmation of the order signifies acceptance of the present GTCS, recognition of acknowledgement and renonciation to prevail any personal terms of sale or any other terms.
Data and confirmation order collected are proof of transaction. Confirmation holds as signature and acceptance of the transaction made.
Sale will be considered valid only after full settlement of the price. It is the Client’s responsibility to check the accuracy of the order and notify immediately any error.
The Service Provider will communicate through email cofirmation of the registered order and an invoice.
The Service Provider reserves the right to cancel or refuse any order from a Client with whom exists a dispute concerning current or previous payments.
6/ Method of payement
Payment is fully due at the time of order.
Payments are made via credit card (Stripe); They are made through a secured system using SSL protocol (Security Socket Layer) in such way that transmitted information are crypte by a software and no third party can read them on the transported network.
7/ Service Delivry
Services ordre by the Client are delivered according to the calendar and conditions specifically indicated in the descriptions read and approved by the Client at the moment of the purchase.
If the ordered Service is not provided on the indicated dates, for any other reason than for a case of force majeure or due to the Client, the purchase of the Service could be resolved at the written demand of the Client. The amount paid by the Client will be refunded at the latest within fourteen working days following the date of termination of contracts, excluding any compensation or amount withheld.
In case of a Client’s personal request concerning the terms of services supply, if fully accepted by the Service Provider, the affiliated costs will be subjected to a specific complementary billing.
In the absence of any expressed retraction from the Client following the order of the services, those will be considered conform to the order in quantity and quality.
8/ Right of Retraction
The Client has a delay of 14 days to exercice the right of retraction from the date the service was purchased.
The right of retraction can be exercised by expressing ones simple will to retract by mail adressed to the Service Provider at the address or email indicated at the beginning of these GTCS.
In cas of retraction in the above-mentioned deadline, only the price of ordered services are refunded.
The Reimbursement of the amount paid by the Client will occur in a period of 14 days from the date the Service Provider has received the Client’s retraction notification.
Notice that right of retraction does not apply to digital products.
Notice that right of retraction does no longer apply when the service is being provided.
9/ SERVICE PROVIDER RESPONSABILITY
The Service Provider, in the online sale procedure, is held accountable only by an obligation of means and cannot be held responsable for a damage resulting from the use of the internet such as data lose, intrusion, virus, service interruption or any other involuntary problem.
The Service Provider cannot be held accountable or defaulting for every delay or non execution of the Service resulting from a case of Force Majeure, usually acknowledge by the french case law.
10/ INTELLECTUAL PROPERTY
The content of the website www.cinetoc.com is property of the Service Provider and his partners and is protected by french and international laws on intellectual property.
Any total or partial reproduction of the content is strictly prohibited, can be an infringement of copyright and could lead to prosecution.
11/ APPLICABLE LAW- LANGUAGE
The present GTCS and resultant operations are subjected to french law. They are written both in english and french. Only the french text prevails in case of litigation.
12/ litigation settlement
The present GTCS are submitted to french law. In case of dispute, jurisdiction us assigned to the relevant PARIS courts, notwithstanding multiple defendants or appeal.
